Terms of Service

1. Acceptance of Terms

By accessing or using CraftCove ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. CraftCove reserves the right to update these Terms at any time, and your continued use of the Platform following any changes constitutes acceptance of those changes.

2. Account Registration

To access certain features of CraftCove, you must create an account. Account authentication is managed through Clerk, our identity provider. By creating an account, you represent that:

  • You are at least 18 years of age.
  • All information you provide during registration is accurate, current, and complete.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activities that occur under your account.

CraftCove reserves the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

3. Marketplace Rules

CraftCove is an online marketplace that connects buyers with independent artisan sellers. CraftCove is not a party to the transactions between buyers and sellers. Each seller is an independent business responsible for their own products, listings, pricing, shipping, and customer service.

CraftCove provides the platform infrastructure, payment processing, and support tools, but does not manufacture, warehouse, or ship any products. Product quality, accuracy of descriptions, and fulfillment are the responsibility of the individual seller.

4. Buyer Responsibilities

As a buyer on CraftCove, you agree to:

  • Provide accurate payment and shipping information at checkout.
  • Write honest and fair reviews based on your genuine experience with the product.
  • Communicate respectfully with sellers through the messaging system.
  • Not misuse the dispute or refund process for fraudulent purposes.
  • Understand that handcrafted items may have minor variations that are inherent to the artisan process and do not constitute defects.

5. Seller Responsibilities

As a seller on CraftCove, you agree to:

  • Provide accurate and truthful product listings, including descriptions, materials, dimensions, and photographs.
  • Ship orders within 3 business days of purchase confirmation and provide tracking information when available.
  • Maintain quality standards consistent with CraftCove's handmade product requirements.
  • Respond to buyer messages and inquiries in a timely manner.
  • Comply with all applicable local, national, and international laws regarding the sale and shipment of goods.

6. Payments and Fees

All payments on CraftCove are processed securely through Stripe. Buyers are charged at the time of purchase. The following fee structure applies:

  • Platform Commission: CraftCove charges sellers a 10% commission on each completed sale.
  • Payment Processing: Standard Stripe processing fees apply to all transactions.
  • Listing Fees: There are no fees to list products on CraftCove.
  • Seller Payouts: Seller funds are transferred via Stripe Connect on a regular payout schedule after order completion.

CraftCove reserves the right to modify the fee structure with 30 days prior notice to sellers.

7. Intellectual Property

Sellers retain full ownership of their product designs, photographs, and descriptions. By listing products on CraftCove, sellers grant CraftCove a non-exclusive, royalty-free license to display, promote, and distribute their content on the Platform and in marketing materials for the purpose of operating the marketplace.

The CraftCove name, logo, and platform design are the intellectual property of CraftCove and may not be used without written permission.

8. Prohibited Items

The following items may not be sold on CraftCove:

  • Counterfeit or imitation goods.
  • Mass-produced or machine-manufactured items (all products must be handmade, hand-assembled, or hand-designed).
  • Dangerous, hazardous, or illegal goods.
  • Items that infringe on another party's intellectual property.
  • Products made from endangered species or prohibited materials.
  • Digital products, services, or gift cards.

CraftCove reserves the right to remove any listing that violates these rules and to suspend sellers who repeatedly list prohibited items.

9. Dispute Resolution

In the event of a dispute between a buyer and seller, CraftCove encourages both parties to resolve the issue directly through the Platform's messaging system. If a resolution cannot be reached:

  • Either party may open a formal dispute through their order management page.
  • CraftCove's support team will review the dispute, communicate with both parties separately, and issue a resolution within 5-10 business days.
  • Resolutions may include full or partial refunds, returns, or other remedies as deemed appropriate.

CraftCove's dispute resolution decisions are final and binding with respect to transactions conducted on the Platform.

10. Limitation of Liability

CraftCove provides the Platform on an "as is" and "as available" basis. To the maximum extent permitted by law, CraftCove shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or goodwill.

CraftCove is not responsible for the quality, safety, legality, or accuracy of any products listed by sellers. Buyers purchase at their own risk, and any claims regarding products should be directed to the seller or through our dispute resolution process.

11. Changes to Terms

CraftCove may update these Terms of Service from time to time. We will notify users of significant changes via email or a prominent notice on the Platform. Your continued use of CraftCove after changes are posted constitutes acceptance of the revised Terms.
